1. Introduction
Welcome to Appyone India (“Company,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of the Appyone India website, platform, and services (collectively, the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Definitions
“Free Website” means the professional 5–8 page website we design, build, and host for you at no upfront design cost.
“Monthly Subscription” means the recurring fee you pay for hosting, AI chat, auto-responses, maintenance, and support. All subscription and additional pricing on this page is stated in Indian Rupees (INR) unless otherwise noted.
“Content” means all text, images, logos, videos, documents, and other materials you provide for your website.
“Platform” means Appyone’s proprietary website and marketing automation platform.
3. Services
3.1 Website Build. Upon your completion of our intake form, we will build a professional website for your business. The build is free of charge. We guarantee delivery of a preview link within 5 business days. If we miss this deadline, your first month of hosting is free.
3.2 Hosting & Maintenance. After you approve the website, it will be published on our platform. The monthly subscription covers hosting, SSL certificate, daily backups, security monitoring, AI chat functionality, missed-enquiry auto-response, SEO maintenance, and ongoing technical support.
3.3 Changes and Revisions. We include up to 2 content change requests per month at no additional cost. Additional changes may incur fees quoted at the time of request.
4. Subscription & Billing
4.1 Fees. You agree to pay the monthly (or annual) subscription fee as displayed on our pricing page at the time of sign-up. Fees are billed in advance on a monthly or annual basis.
4.2 Additional Costs. The following are not included in the subscription and are billed separately: email delivery (~₹0.08/email), SMS delivery (~₹0.01/message), WhatsApp Business API (₹800/month add-on), domain registration (~₹800–1,200/year, if needed), and AI chat overage if usage exceeds fair-use limits.
4.3 Price Changes. We may change our fees with 30 days’ notice. Price changes will not apply during your current billing period.
4.4 Cancellation. You may cancel at any time from your dashboard or by emailing support. Upon cancellation, your subscription will not renew at the end of the current billing period. Your website will remain accessible until the end of the paid period.
5. Your Content & Intellectual Property
5.1 You retain all ownership and intellectual property rights to the Content you provide. We claim no ownership over your Content.
5.2 The website design, layout, code, and platform software created by Appyone remain our intellectual property. We grant you a non-exclusive, non-transferable license to use the website for the duration of your subscription.
5.3 Domain names are registered in your name and remain your property. We will transfer domain management to you upon request and subject to verification.
5.4 Upon termination, we will provide a full content export of your website (pages, copy, images) in a standard format upon request.
6. Your Responsibilities
6.1 You represent that all Content you provide does not violate any law or third-party right.
6.2 You will not use the Services for any illegal purpose or in violation of any applicable laws or regulations.
6.3 You are responsible for maintaining the confidentiality of your account credentials.
6.4 You agree not to attempt to reverse-engineer, copy, or exploit the platform for competing purposes.
7. Third-Party Services
Our platform integrates with third-party services including but not limited to: OpenAI (AI chat), Twilio (SMS), SendGrid (email), and Meta (WhatsApp). Your use of these services is subject to their respective terms of service. We are not responsible for any downtime or issues caused by third-party providers.
8. Limitation of Liability
To the maximum extent permitted by law, Appyone shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability for any claim arising from these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding the uninterrupted or error-free operation of the Services. We do not guarantee specific business outcomes, including but not limited to increased sales, leads, or search engine rankings.
10. Indemnification
You agree to indemnify and hold Appyone harmless from any claims, losses, or expenses (including legal fees) arising from your Content, your violation of these Terms, or your use of the Services in violation of applicable law.
11. Termination
We may suspend or terminate your access to the Services immediately if you breach these Terms or engage in any activity that could harm our platform or other users. Upon termination, you must cease all use of the Services. We will provide a content export within 14 days of termination upon request.
12. Governing Law
These Terms shall be governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the Services after changes constitutes acceptance of the updated Terms.
